Terms and Conditions for SHANKS TIX
1. Introduction
This Agreement (the “Agreement”) governs the relationship between SHANKS TIX (the “Platform”), the event organizers (the “Vendors”) and the ticket buyers (the “Users”) using the Platform. By accessing or using the SHANKS TIX Platform, Users and Vendors agree to be bound by these Terms and Conditions.
2. Platform Description
SHANKS TIX is an online platform that facilitates the sale of tickets to various events organized by different Vendors. The Platform does not own or control the events listed on the Platform. All events and tickets are provided by the respective Vendors.
3. User Accounts
Users must create an account to purchase tickets on the SHANKS TIX Platform. Users are responsible for maintaining the confidentiality of their account information, including password and email address. Users agree to provide accurate and complete information when creating an account. SHANKS TIX reserves the right to suspend or terminate any User account for violation of these Terms and Conditions or for any other reason without prior notice.
4. Ticket Purchase
Ticket prices and availability are determined by the respective Vendors and are subject to change without notice. Users are responsible for reviewing all event details, including ticket prices, terms, and conditions, age restrictions, and any other relevant information before making a purchase. Payment for tickets is processed through a secure payment gateway. SHANKS TIX does not store or process payment information. Once a ticket purchase is confirmed, it is considered final and non-refundable unless otherwise stated by the Vendor or as provided in these Terms and Conditions.
5. Ticket Delivery
Tickets may be delivered electronically (e-tickets) or physically, as determined by the Vendor. SHANKS TIX is not responsible for lost, stolen, or damaged tickets. It is the User’s responsibility to ensure that the email address provided during the purchase is correct to receive e-tickets.
6. Event Cancellation or Changes
If an event is canceled or rescheduled, the Vendor is responsible for notifying Users and providing refunds or alternative arrangements as required by law. SHANKS TIX will use reasonable efforts to notify Users of event cancellations or changes but is not liable for any losses incurred by Users due to such changes.
7. Vendor Responsibilities
Vendors are solely responsible for all aspects of their events, including but not limited to ticket pricing, availability, refunds, customer service, and compliance with all applicable laws and regulations. Vendors must ensure that all event information provided to SHANKS TIX is accurate and complete. SHANKS TIX reserves the right to remove any Vendor from the Platform for violating these Terms and Conditions or engaging in fraudulent or illegal activities.
8. Limitation of Liability
To the maximum extent permitted by law, SHANKS TIX and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses arising from or in connection with the use or inability to use the Platform or any content, information, or materials provided on the Platform. SHANKS TIX does not guarantee the accuracy or completeness of the information provided by Vendors. Users should exercise caution and verify information independently.
9. Intellectual Property
All intellectual property rights related to the SHANKS TIX Platform, including but not limited to trademarks, copyrights, and patents, belong to SHANKS TIX. Vendors retain ownership of their intellectual property related to their events.
10. Indemnification
Users and Vendors agree to indemnify and hold harmless SHANKS TIX and its affiliates from any claims, damages, or liabilities arising out of their use of the Platform or violation of these Terms and Conditions.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of FEDERAL REPUBLIC OF NIGERIA .
12. Changes to Terms and Conditions
SHANKS TIX reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting on the Platform.
13. User Conduct
Users agree to use the SHANKS TIX Platform in compliance with all applicable laws and regulations. Users shall not: Use the Platform for any unlawful or prohibited purpose. Attempt to interfere with the proper functioning of the Platform. Upload, transmit, or distribute any harmful, threatening, abusive, or offensive content. Impersonate any person or entity. Violate the privacy rights of others.
14. Privacy Policy
SHANKS TIX respects the privacy of its Users and collects and uses personal information in accordance with its Privacy Policy, which is incorporated into these Terms and Conditions by reference.
15. Dispute Resolution
Any disputes arising out of or in connection with this Agreement shall be resolved through [negotiation, mediation, or arbitration] as agreed upon by the parties.
16. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, such provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable.
17. Entire Agreement
These Terms and Conditions constitute the entire agreement between the parties and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
